CONSENT OF PERSONAL DATA

This Consent is an integral part of the Privacy and Personal Data Protection Policy and constitutes official confirmation of the voluntary expression of will and full awareness of the User (Buyer). By using the website of the online store on the Shopify platform, creating an account, or making purchases, the User, as a data subject, declares that they have carefully read this document and fully agree with it.

In accordance with the Law of Ukraine “On Personal Data Protection,” for the purpose of ensuring compliance with applicable legislation, maintaining a personal data database, organizing the process of selling and delivering goods, providing quality customer support, and conducting marketing and statistical research, the data subject grants the Data Controller PE SYDORENKO ANASTASIIA OLEHIVNA (Taxpayer Identification Number / RNOKPP 3581003744) unambiguous consent to:

  • Processing of personal data to the extent necessary for order fulfillment, including: last name, first name, patronymic, contact phone number, e-mail address, delivery address (city, postal operator branch, or street, building, apartment), purchase history data, and technical identification data (IP address, cookie files collected by the Shopify platform);

  • Use of personal data, meaning any actions by the Data Controller involving their collection, registration, accumulation, storage, adaptation, updating, use, de-identification, and protection;

  • Disclosure and transfer of personal data to third parties to the minimum extent necessary (in accordance with Article 14 of the Law of Ukraine “On Personal Data Protection”), exclusively for order fulfillment purposes, namely: to carrier companies and delivery services (e.g., “Nova Poshta,” “Ukrposhta”), payment system operators (including the “Khutko” payment acquiring service) for settlement purposes, and technical contractors ensuring the operation of the online store’s infrastructure on Shopify.

  • Cross-border transfer of personal data. The data subject is aware of and agrees that the Site’s technical infrastructure operates on the Shopify platform, whose servers may be located outside Ukraine. Accordingly, personal data may be processed and stored on servers in other countries, provided that Shopify ensures an adequate level of personal data protection in accordance with international security standards.

This consent is granted for the entire period necessary to achieve the purposes of personal data processing (including the fulfillment of contractual obligations and compliance with the requirements of Ukrainian tax and accounting legislation), unless otherwise provided by applicable legal and regulatory acts.

The data subject confirms that they understand their rights as defined by the Law of Ukraine “On Personal Data Protection,” as well as the mechanism for withdrawing this consent or amending their data by sending a corresponding request to the online store administration’s e-mail address: obertystore@gmail.com.

Any disputes and disagreements that may arise between the Data Controller and the data subject shall be resolved through negotiations. If a dispute cannot be settled out of court, it shall be resolved by the courts of Ukraine in accordance with applicable legislation.
